The Massachusetts Legislature defines Leaving the Scene of Personal Injury under Massachusetts General Law Chapter 90, § 24(2)(a½)(1) as follows:

(a1/2) (1) Whoever operates a motor vehicle upon any way or in any place to which the public has right of access, or upon any way or in any place to which members of the public shall have access as invitees or licensees, and without stopping and making known his name, residence and the registration number of his motor vehicle, goes away after knowingly colliding with or otherwise causing injury to any person not resulting in the death of any person, shall be punished by imprisonment for not less than six months nor more than two years and by a fine of not less than five hundred dollars nor more than one thousand dollars.

The model jury instructions for use in the District Court requires the Commonwealth to prove the following in order for the Commonwealth to prove each element of the offense. The Commonwealth must prove each of the following elements beyond a reasonable doubt at trial:

First: That the defendant operated a motor vehicle;

Second: That (he) (she) operated it (on a way) (or) (in a place where the public has a right of access) (or) (upon a way or in a place where members of the public have access as invitees or licensees);

Third: That the defendant knowingly collided with or otherwise injured another person;

Fourth: That after such collision or injury, the defendant did not stop and make known (his) (her) name, home address, and the registration number of (his) (her) motor vehicle.
